CUSTOMS NOTIFICATION IN THE FRAMEWORK ENTRY OF GOODS FROM OTHER PLACE IN CUSTOMS AREA INTO PLACE UNDER SUPERVISORY OF DIRECTORATE GENERAL OF CUSTOMS AND EXCISE

Attachment

Considering:

that in the framework to implement provision in Article 11 of Regulation of the Finance Minister No. 155/PMK.04/2008 concerning Customs Notification, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning Customs Notification in the Framework Entry of Goods from Other Place in Customs Area into Place Under Supervisory of Directorate General of Customs and Excise;

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book of the Republic of Indonesia No. 93/2006, Supplement to Statute Book of the Republic of Indonesia No. 4661);

2. Law No. 11/1995 concerning Excise (Statute Book of the Republic of Indonesia No. 76/1995, Supplement to Statute Book of the Republic of Indonesia No. 3613) as amended by Law No. 39/2007 (Statute Book of the Republic of Indonesia No. 105/2007, Supplement to Statute Book of the Republic of Indonesia No. 4755);

3. Regulation of the Minister of Finance No. 100/PMK.01/2006 concerning the Organization and Work Mechanism of the Finance Ministry that is amended by Regulation of the Finance Minister No. 149/PMK.01/2008;

4. Regulation of the Finance Minister No. 155/PMK.04/2008 concerning Customs Notification;

DECIDES:

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING CUSTOMS NOTIFICATION IN THE FRAMEWORK ENTRY OF GOODS FROM OTHER PLACE IN CUSTOMS AREA INTO PLACE UNDER SUPERVISORY OF DIRECTORATE GENERAL OF CUSTOMS AND EXCISE

CHAPTER I
GENERAL PROVISION

Article 1

In this Regulation of the Director General:

1. Customs Law is Law No. 10/1995 concerning Customs as amended by Law No. 17/2006 concerning Amendment to the Law No. 10/1995 concerning Customs.

2. Electronic Data are information or a set of information compiled and/or gathered for special use, received, recorded, sent, stored, processed, withdrawn, or produced electronically using computers or electronic data processing instruments, optics or other similar means.

3. Customs Electronic Data Exchange hereinafter abbreviated Customs PDE is process of sending customs documents in the form of electronic data exchange through inter application and inter organization communication that is integrated by using data communication system equipment.

4. Bonded Piling Place is building, place, or zone that fulfill specified requirements that is used to pile goods with the certain purpose by get pending of Import Duty.

5. Customs Office is office in the Directorate General of Customs and Excise environment to fulfill customs obligation in according to Customs Law.

Article 2

Customs Notification in the Framework Entry of Goods from Other Place in Customs Area into Place Under Supervisory of Directorate General of Customs and Excise consists of:

CHAPTER II
NOTIFICATION OF ENTRY GOODS FROM OTHER PLACE IN CUSTOMS AREA INTO BONDED PILING PLACE

Article 3

(1) Notification of Entry Goods from Other Place in Customs Area into Bonded Piling Place as intended in Article 2 paragraph a can be submitted in the form of writing in the form or electronic data.

(2) Notification of Entry Goods from Other Place in Customs Area into Bonded Piling Place as intended in paragraph (1) is stipulated with BC 4.0 code.

(3) Form as intended in paragraph (2) shall:

Article 4

(1) Notification of Entry Goods from Other Place in Customs Area into Bonded Piling Place as intended in Article 2 paragraph b shall be filled completely by using Indonesian Language, Latin text, and Arabic number.

(2) Filling Notification of Entry Goods from Other Place in Customs Area into Bonded Piling Place as intended in paragraph (1) can use English in case:

Article 5

The model, content, and filling guide of Notification of Release Back Goods Origin from Other Place in Customs Area from Bonded Piling Place as set forth in Attachment I that in an integral part of this Regulation of the Director General.

CHAPTER III
NOTIFICATION OF RELEASE BACK GOODS ORIGIN FROM OTHER PLACE IN CUSTOMS AREA FROM BONDED PILING PLACE

Article 6

(1) Notification of Release Back Goods Origin from Other Place in Customs Area from Bonded Piling Place as intended in Article 2 paragraph b can be submitted in the form of writing in the form or electronic data.

(2) Notification of Release Back Goods Origin from Other Place in Customs Area from Bonded Piling Place form as intended in paragraph (1) is stipulated with BC 4.1 code.

(3) Form as intended in paragraph (2) shall:

Article 7

(1) Notification of Release Back Goods Origin from Other Place in Customs Area from Bonded Piling Place as intended in Article 2 paragraph b shall be filled completely by using Indonesian Language, Latin text, and Arabic number.

(2) Filling Notification of Release Back Goods Origin from Other Place in Customs Area from Bonded Piling Place as intended in paragraph (1) can use English in case:

Article 8

The model, content, and filling guide of Notification of Release Back Goods Origin from Other Place in Customs Area from Bonded Piling Place as set forth in Attachment II that in an integral part of this Regulation of the Director General.

CHAPTER IV
TRANSITIONAL PROVISION

Article 9

Entry and release back goods origin from Other Place in Customs Area into and from Bonded Zone uses Customs Notification as set forth in Attachment III that is an integral part of this Regulation of the Director General be retroactive to December 26, 2008 until This Regulation of the Director General comes into force.

CHAPTER V
CLOSING PROVISION

Article 10

This Regulation of the Director General shall come into force 60 (sixty) days after the date of stipulation.
